Registered Sale Deed Disputes

Sale Deed પછી Balance Price બાકી? | Non-payment, Void Sale અને Seller Rights

1. Section 54માં price paid અથવા promised

Transfer of Property Act Section 54 saleને ownership transfer in exchange for a price paid or promised or part-paid and part-promised તરીકે define કરે છે.

2. Dahiben: unpaid balance એટલે cancellation નહીં

Dahiben v. Arvindbhai Kalyanji Bhanusali, 9 July 2020માં Supreme Courtએ alleged non-payment of part considerationના contextમાં Section 54 સમજાવ્યો. Title already pass થઈ ગયું હોય તો balance unpaid છે તે groundથી sale invalidated કરી શકાય નહીં; recovery of balance considerationનો remedy relevant રહે છે. [2]

3. August 2026 decision

Raziya Begum v.

Latest decisionનો useful point છે: unfulfilled payment promiseને automatically absence of saleમાં convert ન કરો.

4. Kewal Krishan: no price and no future provision

Kewal Krishan v. Rajesh Kumar, 22 November 2021માં Courtએ અલગ factual situation તપાસી. Attorneyએ principalની property પોતાની wife/minor sonsને purportedly sell કરી હતી; paymentનો evidence નહોતો અને transactions sham/without consideration હોવાનું finding હતું. [4]

Kewal Krishanમાં absence of consideration અને future price provisionનો પ્રશ્ન હતો; Dahiben અને Raziyaમાં price paid/promised અને unpaid balanceનો distinction હતો.

Kaliaperumal v.

"Price later payable" અને "ownership only after price receipt" વચ્ચે ફરક છે.

Statute buyer અને specified transferees સામે scope બતાવે છે, including without-consideration transferee અથવા non-paymentની notice ધરાવતો transferee. [6]

આ chargeને automatic cancellation અથવા automatic possession right માની ન લો.

7. Wrong remedy અને delayનું risk

Recovery, declaration, cancellation અને possession માટે same legal theory નહીં હોય. Payment claimને માત્ર deed cancellation તરીકે frame કરવાથી actual cause of action અને limitationના questions ઊભા થઈ શકે છે.

8. Review માટે practical evidence file

આ review checklist છે, universal filing list નહીં. Original records સાચવો; payment recitalsને convenient new statementથી replace અથવા backdate ન કરો.

Bottom line: Unpaid balance, no consideration Actual wording અને evidenceથી right remedy પસંદ કરો.
