Banakhat પછી Seller Sale Deed ન કરે? | Specific Performance, Readiness અને Limitation

Contractના essential terms, buyerની readiness and willingness, sellerના obligations, refusalનો evidence અને limitation સાથે review જરૂરી છે.

Transfer of Property Act Section

Mohammed Khaleel v. [2]

Readiness: relevant timeએ balance consideration અને contractual performance માટે capacity હતી?

Likewise bank balance હોવો અને agreement મુજબ necessary step timely કરવો same નથી.

Section 16(c)નો readiness/willingness bar મહત્વનો છે; prevented or waived termsનો qualification પણ ધ્યાનમાં રાખવો. [2][3]

Subhash Aggarwal v.

Courtએ no straitjacket formula કહ્યું.

પરંતુ readiness and willingness prove કરવાની requirement રહે છે. [3][5]

M/s Siddamsetty Infra Projects v.

6. Three years કઈ dateથી?

Limitation Act Article 54 specific-performance suit માટે three years આપે છે: performance માટે date fixed હોય તો તે dateથી; such date fixed ન હોય તો plaintiffને performance refused થયાની notice મળે ત્યારથી. Supreme Courtના 2024 review judgmentના paragraphs 21-22 આ distinction reproduce કરે છે. [5]

"Notice આજે મોકલી એટલે આજથી નવા three years" અથવા "agreement signed dateથી હંમેશાં three years" એવા answers ન લો.

આ general period તમારા matter માટે last filing date નથી. Applicable limitation provisions, legally relevant events અને computation individual review માંગે છે. Article 54નો time budget wait કરવાની advice નથી.

7. 2018 amendment અને old casesનો trap

Specific Relief (Amendment) Act, 2018એ Section 10 substitute કર્યો: specific performance "shall be enforced" subject to Sections 11(2), 14 અને 16. Section 16(c)માં "aver and prove"માંથી "aver" remove થયો, પરંતુ prove અને readiness/willingnessનો substantive requirement દૂર થયો નથી. Official amendment text તપાસો. [6]

Old Section 10નું broad discretion wording ધરાવતી online reproductionને current law માની copy ન કરો. Likewise 1990/2008 agreement અંગેના judgmentમાં pre-amendment discretionary/equitable language દેખાય એટલે તે દરેક new contract માટે same rule છે એવું ન માનો.

8. Lawyerને આપવાની practical file

Possible relief specific performance છે, monetary claim છે કે other remedy, તે full facts અને pleading strategy સાથે નક્કી કરો.

Contract sequence, continuous readiness/willingness, legal version અને correct limitation trigger check કરો.
