Opposition, renewal fee અને non-use removal એક જ proceeding નથી; કોઈ filing fee, fixed disposal time કે successની ખાતરી અહીં આપવામાં આવતી નથી.
Section 47(1)(a)માં registration સમયે relevant goods/services માટે bona fide intention ન હોવો અને applicationથી ત્રણ મહિના પહેલાંની relevant date સુધી હકીકતમાં bona fide use ન હોવો, બંને matters આવે છે.
Clause (a)ના બે conditions cumulative છે, જ્યારે clauses (a) અને (b) જુદા grounds છે. [1][4][5]
2. Five-year clock application date
Section 47(1)(b)નો શબ્દપ્રયોગ "actually entered in the register" છે.
Licence, consent, actual use અને chain of ownershipનાં documents સાથે વાંચો.
Section 47(3) clause (b) તથા subsection (2) માટે special circumstances in the tradeનો defence આપે છે.
Own proposed activity, objection
8. Owner અને challenger માટે evidence checklist
- Owner: dated invoices, product/packaging records, genuine advertisements, distributor correspondence, service-delivery evidence અને permitted-use agreements સાચવો.
Existing registration, other proprietorsનાં rights, actual goodwill અને passing-off exposureનો separate clearance જરૂરી છે. Removal orderની scope અને other surviving rights તપાસ્યા વગર packaging, signage અને stockમાં મોટું investment ન કરવું.
