Trademark registrationની scope સમજવા mark as a whole, distinctive element, goods/services અને actual market use અલગથી જોવાં પડે.

2. Logo registration અને word monopoly વચ્ચે Section 17

Section 17(1) કહે છે કે several matters ધરાવતા markની registrationથી exclusive right trade mark taken as a whole માટે મળે છે. Section 17(2) common-to-trade અથવા non-distinctive matter સહિત specified component situationsમાં whole registrationથી તે part પર separate exclusive right મળતો નથી તે સ્પષ્ટ કરે છે. [1]

Actual registered representation, goods/services specification, conditions/limitations અને any separate word-mark application/registration તપાસો.

Section 28 હેઠળ valid registrationના rights Actની other provisions અને registrationની limitationsને subject છે.

Registrar of Trade Marks v. [2]

આ decision Trade Marks Act, 1940 હેઠળ હતો. તેથી તેની old Section 13 અથવા disclaimer procedureને today's automatic filing formula તરીકે વાપરશો નહીં.

Godfrey Philips India Ltd. v. Courtએ factual question consider કરવા matter remand કર્યો; તે order final finding of acquired distinctiveness નહોતો. [3]

5. Honest description અને rival brand તરીકે use

Marico Ltd. v. Agro Tech Foods Ltd., Delhi High Court Division Bench, 1 November 2010માં "LOSORB/LO-SORB" અને "WITH LOW ABSORB TECHNOLOGY" dispute હતો. [4]

Section 30(2)(a) goods/servicesની kind, quality, purpose, geographical origin વગેરે indicate કરતા use માટે infringement limitation આપે છે. Section 35 bona fide description સહિત specified useને save કરે છે. પરંતુ rivalની reputation પર ride કરવા માટે similar badge of origin, confusing overall label અથવા deceptive presentation બનાવવું માત્ર "description" કહી દેવાથી safe થતું નથી. Exact words ઉપરાંત prominence, layout, accompanying brand અને market context જુઓ. [1][4]

ખાસ કરીને Section 30(1)નું honest identification use અને Section 30(2)(a)નું descriptive use અલગ text ધરાવે છે. એક universal "fair use" sloganથી statutory conditionsનું analysis replace ન કરો.

J.R. Kapoor v.

Same dominant distinctive feature These Delhi decisions are explanatory authorities; specific disputeમાં applicable binding law અને later developments તપાસવા પડે.

Section 27(2) passing-off rightsને preserve કરે છે. [1]
