Title will પ્રમાણે કે intestate succession પ્રમાણે heirsને જાય; recordsમાં varsai/mutation entry એ ફક્ત revenue record update છે.
3. Court procedure - Section 372
Hearing (Section 373): Judge ground જુએ તો hearingનો દિવસ fix કરે, જેમને special notice જોઈએ એમને notice serve થાય, court-houseના conspicuous part પર notice post થાય, અને summary mannerમાં right નક્કી થાય. [3]
Certificateનો effect (Section 381): Certificate debtor માટે conclusive છે - bank/company certificate ધારકને good faithમાં payment કરે તો full indemnity મળે છે.
Banking Regulation Actની Section 45ZA વાંચો: depositor nomination કરી શકે, અને મૃત્યુ પછી nominee deposit receive કરવાનો હકદાર બને "to the exclusion of all other persons" - એટલે bank nomineeને payment કરી શકે અને bankની liability પૂરી થાય (45ZA(4)). [5]
Supreme Courtે Sarbati Devi v. Usha Devi, (1984) 1 SCC 424માં એ જ principle સ્પષ્ટ કર્યું (insurance nomination contextમાં): "nomination only indicates the hand which is authorised to receive the amount" - nomineeને payment મળવાથી એમાં કોઈ beneficial interest મળતો નથી.
Nomination એ convenience mechanism છે, estate planning નથી - Will એ distributionનો અસલી document છે.
Male Hindu (Buddhist, Jain, Sikh સહિત) intestate - will વગર - મરે તો Hindu Succession Act, 1956ની Section 8 લાગુ પડે: property પહેલા Class I heirs (Schedule મુજબ - widow, mother, sons અને daughters સહિત) પાસે જાય; Class I ન હોય તો Class II, પછી agnates/cognates. Will હોય તો Will પ્રમાણે distribution થાય - પણ Willની validity challenge થઈ શકે, એ અલગ litigation છે. [7]
6. Practical checklist - મૃત્યુ પછીના paper work
- Succession petition: Nomination/will
7. Bottom line
