Vineeta Sharma v. Rakesh Sharma (2020)માં Supreme Courtએ amended Hindu Succession Act Section6 હેઠળ daughterના coparcenary rights સમજાવ્યા. [1]
Ram Charan v.
Section6 birth-based coparcenary rightનો પ્રશ્ન છે.
Commissioner of Wealth Tax v.
Dates, mode of devolution, prior partitions અને title documents સાથે property trace કરો.
[4] Valid Will હોય, other heirs હોય અથવા different facts હોય તો outcome/extent ફરી તપાસવાના છે.
3. Daughter born before2005
Vineeta Sharmaના paragraph129માં Courtએ substituted Section6 daughter born before or after amendmentને son જેવી coparcener status, same rights અને liabilities આપે છે એવું કહ્યું. Earlier-born daughters rights 9 September2005થી claim કરી શકે, statutory savings subject to. [1]
Coparcenary right by birth છે.
4. Father9 September2005એ alive હોવો જરૂરી?
Vineeta Sharmaનો clear answer: father coparcener તે dateએ living હોવો જરૂરી નથી, કારણ કે right coparcenaryમાં birthથી છે. [1]
At the same time valid prior partition/disposition, propertyનું character અને statutory savingsને ignore નહીં.
Courtએ old Section6નું notional partition fiction, deceasedના share ascertain કરવા માટે, actual disruption/partition સમાન નથી એવું પણ સમજાવ્યું.
Old sale deed, partition deed, court decree અથવા Will present થાય ત્યારે original/reliable copy મેળવો. Mutation entry alone transactionની complete legal effectનો જવાબ નથી. Dates અને property schedule match કરો.
7. Oral partition
Judgmentએ exceptional casesમાં public documents supported plea, finally evidenced as if effected by court decree, અંગે narrow qualification પણ રાખી.
- Complete family tree, births/deaths અને relevant dates.
- Title chain: purchase, inheritance, gift, partition અને transfers.
- Claimed coparcenary/HUF historyના supporting records.
- Earlier registered deeds, decrees, Wills અને settlement/release papers.
- Land/property records, schedule, survey details અને current possession.
- Earlier court cases, notices અને agreed arrangements.
Other heirs, deaths, devolution, property character અને prior transactions જરૂરી છે.
FAQs

Marriage alone central Section6માં exclusion નથી. Property character અને other legal facts તપાસો.
Prior valid disposition/partition અને other facts હજુ મહત્વના છે.
Testatorના transferable interest, property's character, actual Willની validity અને applicable law જુદા questions છે. No blanket answer.
